Terms & Conditions

This English text is a convenience translation. The legally binding version is the German one, available at AGB.

General Terms and Conditions (GTC) for accommodation in the apartments of Shalala Living Mariazell. As of: July 2026.

1. Scope & contracting party

These GTC apply to the booking and accommodation in the apartments "Shalala Living Mariazell" at Pater-Heinrich-Abel-Platz 2 as well as on the main square (Hauptplatz), 8630 Mariazell, operated by MBM Hospitality Services GmbH, Krichbaumgasse 13/32, 1120 Wien (hereinafter "Landlord"). Any deviating conditions of the guest are hereby rejected, unless they have been expressly agreed to in writing.

2. Conclusion of contract

The presentation of the apartments on this website does not constitute a legally binding offer, but a non-binding invitation to book. By completing the booking process via the embedded booking system (Smoobu), the guest makes a binding offer to conclude an accommodation contract. The contract is concluded upon the booking/payment confirmation by the Landlord (usually by email).

3. Services, prices & local tourist tax

What is owed is the provision of the booked apartment for temporary accommodation, together with the described amenities, for the booked period. The prices displayed in the booking system at the time of booking apply. Unless stated otherwise, prices are inclusive of statutory VAT and inclusive of the local tourist tax. Any additional services (e.g. cleaning, additional guests) are shown separately.

4. Payment

Payment is made via the payment methods offered in the booking system (e.g. credit/debit card via the payment service provider Stripe). Depending on the booking, the total amount or a deposit is due immediately; any remaining balance is due at the time stated in the booking process. If the guest fails to meet their payment obligation on time, the Landlord is entitled, after setting a reasonable grace period, to withdraw from the contract and cancel the booking.

5. Arrival and departure (check-in / check-out)

The apartment is available on the day of arrival from the time stated in the booking process and must be vacated on the day of departure by the stated time. Check-in is generally self-service (e.g. via a key box); the access details are provided in good time. Earlier arrival or later departure is only possible by prior arrangement. The standard times are: check-in from 16:00, check-out until 11:00.

6. Withdrawal by the guest / cancellation conditions

The cancellation conditions as per the booking apply. The respective applicable cancellation conditions are shown to the guest during the booking process before completing the booking and form part of the contract. Cancellation must be made in text form (e.g. by email to welcome@hospitalityservices.at); the receipt of the cancellation by the Landlord is decisive for meeting the deadline.

7. Non-arrival (no-show)

If the guest does not arrive without cancelling (no-show), the cancellation conditions confirmed during the booking process apply. The apartment is held until no later than 12:00 of the following day, unless another arrangement has been made.

8. Withdrawal by the Landlord / force majeure

The Landlord is entitled to withdraw from the contract for good cause, in particular if force majeure or other circumstances for which the Landlord is not responsible make performance impossible, if the booking was made on the basis of misleading or false information, or if there is justified reason to assume that the use endangers the proper operation, the safety or the reputation of the property. In these cases, payments already made for services not rendered are refunded; further claims by the guest are excluded, insofar as the Landlord is not at fault.

9. No right of withdrawal for accommodation contracts

For contracts on accommodation for a specific date or period, there is no statutory right of cancellation/withdrawal pursuant to § 18(1)(10) of the Distance and Off-Premises Transactions Act (FAGG). Only the agreed cancellation conditions apply (section 6).

10. Guest's obligations / house rules

  • The apartment may only be occupied by the number of persons booked. Overoccupancy or passing on/subletting to third parties is not permitted.
  • The apartment is to be treated with care. Smoking is prohibited in all interior areas.
  • Quiet hours (generally 22:00–07:00) are to be respected. Parties and events are not permitted.
  • Pets are only allowed with the prior consent of the Landlord.
  • On departure, the apartment is to be handed over swept clean and in proper condition; keys/access means are to be returned or left in the agreed condition.

11. Guest's liability

The guest is liable, in accordance with the statutory provisions, for damage to the apartment, the furnishings or the building culpably caused by the guest, their fellow travellers or visitors. Damage must be reported to the Landlord without delay.

12. Landlord's liability

The Landlord is liable, in accordance with the statutory provisions, for damage resulting from injury to life, body or health, as well as for other damage based on an intentional or grossly negligent breach of duty. Liability for material and financial damage caused by slight negligence is excluded insofar as legally permissible. For items brought in, §§ 970 et seq. ABGB apply. No liability is assumed for the safekeeping of valuables, unless a separate safekeeping contract exists.

13. Registration obligation

The guest is obliged to provide truthfully the information required for the statutory guest registration (Registration Act, Meldegesetz). The data is processed exclusively to fulfil the statutory registration obligations.

14. Data protection

The processing of personal data is carried out in accordance with our privacy policy.

15. Warranty & complaints

Defects or complaints must be reported to the Landlord without delay on site, so that remedy can be provided. If the guest fails to make such a report, this may reduce or exclude their claims.

16. Applicable law, place of jurisdiction, online dispute resolution

Austrian law applies, to the exclusion of the referral rules of private international law and of the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the state in which the guest has their habitual residence as a consumer remain unaffected. The place of jurisdiction is – insofar as legally permissible – the registered office of the Landlord; in relation to consumers, the statutory places of jurisdiction apply. The EU Commission provides a platform for online dispute resolution: ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

17. Final provisions

Should individual provisions of these GTC be or become invalid or unenforceable, the validity of the remaining provisions remains unaffected. Amendments and supplements must be made in text form.
